DNA Testing Kit Traps Spitting Yob

A Manchester traffic warden who was assaulted by a driver recently brought his aggressor to justice using a specially issued spit testing kit. The new spit testing kit was just £1 and they have been issued to wardens by the NCP in order to tackle the large amount of abuse and assault which traffic wardens now face whilst trying to carry out their roles on the streets.

The attacking driver was called Dennis Samms and he spat in the traffic warden's face several times and then proceeded to drive his car at him with the apparent intention of running him over. Samms' was connected to the crime and arrested thanks to the traffic warden waiting on the road side for his colleague. They then took swabs of the offending saliva from the warden's face using the special spit kit and it was these samples which lead to Samms' arrest. In the UK this case is the first of its kind involving the DNA testing kit and a traffic warden.

In court, the Judge told Samms that he may face jail and condemned his behaviour. The court heard that Samms intentionally drove towards the traffic warden aggressively and forced him to shelter behind a parking meter in case he was hit. The warden also described having to wait for 4 minutes without wiping his face so that his colleague could reach him and collect the samples of Samms' saliva. Samms pleaded guilty to the assault and expressed remorse through his defence lawyer.

DNA Testing Kit

The spit testing kits are simple, saliva is taken with a swab and then the DNA is referenced against all of the details held on file by police. Often, in a relatively short amount of time the police computers can positively identify the assaulting driver.

Members of National Rail staff in Manchester have also been issued the kits to crack down on the number of people spitting on the floor and similarly assaulting train staff. In fact, earlier this year one man was jailed for a month following a conviction gained using this DNA matching technology.

In an article for the Manchester Evening News the traffic warden in question spoke about the ordeal: "I'm glad he was taken to court and pleaded guilty." The warden said: " It's not very nice to be abused when you are trying to do your job. Hopefully this will help people realise that they can't get away with doing this."

Aggressive Behaviour

According to the Manchester Evening News the Judge on the case also highlighted the fact that more serious risks do exist than one might expect when it comes to the issue of spitting. In fact, District Judge Paul Richardson said: "In these days of HIV and Aids spitting in this fashion takes on a hugely more serious aspect. You did no physical injury but the incident must have frightened your victim most severely." He added firmly: "I'm not ruling out a custodial sentence."

Peter Casson, Samms' defence lawyer, noted that Samms was partially disabled and described him as 'having become frustrated.' Speaking about Samms' attitude to the situation in retrospect, (in the Manchester Evening News article) Casson said: "He accepts there was no excuse for what he did and he is genuinely full of remorse."
